1. Overview

This website is operated by Nail Void, ABN: 32996188146.

Throughout these Terms of Service, “Nail Void”, “we”, “us” and “our” refer to Nail Void. “You” and “your” refer to anyone who visits our website, places an order or uses our services.

By accessing our website, creating an account or purchasing a product, you agree to these Terms of Service and any policies referenced in them, including our Privacy Policy, Shipping Policy and Returns and Exchanges Policy.

If you do not agree to these Terms, please do not use our website.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell products to you.

2. Eligibility

You must be at least 18 years old or have permission from a parent or legal guardian to place an order.

By placing an order, you confirm that:

the information you provide is complete and accurate;
you are authorised to use the selected payment method; and
you are legally capable of entering into a binding agreement.

Products intended for use by minors should only be used under appropriate adult supervision.

3. Acceptable use

You must not use our website, products or services:

for any unlawful or unauthorised purpose;
to violate another person’s intellectual property, privacy or other rights;
to submit false, fraudulent or misleading information;
to distribute viruses, malware or other harmful code;
to scrape, copy or commercially exploit website content without permission;
to interfere with the website’s security or operation; or
to harass, abuse, threaten or discriminate against another person.

We may suspend or terminate access where we reasonably believe these Terms have been materially breached.

4. Product information

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes, prices and availability are accurate.

Colours and finishes may appear differently depending on your screen, lighting and device settings.

Some Nail Void products are handmade or hand-finished. Minor differences in pattern, decoration, colour placement, shape or finish may occur between products. Reasonable handmade variations are not necessarily defects.

Product designs, descriptions, prices and availability may be changed or discontinued without notice.

Nothing in this section limits your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to meet an applicable consumer guarantee.

5. Nail sizing

Customers are responsible for reviewing our sizing guide and selecting their size before placing an order.

Nails should be measured across the widest part of the natural nail bed, following its natural curve. Sizing can vary between individuals, hands and nail shapes.

If you are unsure about your size, please contact hello@nailvoid.com before ordering.

Returns or exchanges relating to an incorrectly selected size are handled according to our Returns and Exchanges Policy. This does not limit any rights you may have where the sizing information supplied by us was inaccurate or misleading.

6. Product use and safety

Press-on nails, adhesives and accessories must be used according to the instructions and warnings provided with the product or published on our website.

Before using nail glue or another adhesive:

review the ingredients and manufacturer’s warnings;
do not use it if you know or suspect that you are allergic or sensitive to an ingredient;
avoid contact with eyes, mouth, damaged skin and irritated skin;
keep it away from children, pets, heat and flames; and
store and dispose of it according to the instructions.

Stop using the product if irritation, redness, swelling, pain or another adverse reaction occurs. Seek medical advice if symptoms are serious or continue.

Wear time, application time and reusability depend on factors including nail preparation, application method, adhesive, lifestyle, natural nail condition and aftercare. Any estimated wear time is a guide and not a guaranteed result.

Nail Void is not responsible for damage caused by misuse, failure to follow instructions or use contrary to a product warning, except where liability cannot legally be excluded.

7. Orders and acceptance

Submitting an order is an offer to purchase products from us. An order is accepted when we send an order confirmation or dispatch confirmation.

We may reasonably refuse, limit or cancel an order if:

a product is unavailable;
payment cannot be authorised;
pricing or product information contains an obvious error;
the delivery address is incomplete or unsupported;
a product cannot legally or safely be delivered to the selected destination;
we reasonably suspect fraud, misuse or unauthorised resale; or
the order breaches these Terms.

If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.

You are responsible for providing complete and accurate billing, delivery and contact information.

8. Prices, currencies and payment

Prices are displayed in the currency selected on the website or shown at checkout.

Prices may be converted through Shopify or a third-party payment service. Currency conversions are estimates and may vary according to the exchange rate used at checkout or by your payment provider.

Your bank or payment provider may charge foreign transaction, currency-conversion or other fees. Nail Void does not control these charges.

Shipping fees, applicable taxes and other charges collected by us will be displayed before you complete your order.

Payment must be successfully authorised before an order is processed.

9. Promotions and discount codes

Promotions and discount codes are subject to the conditions stated with each offer.

Unless otherwise specified:

only one discount code may be used per order;
discounts cannot be exchanged for cash;
codes cannot be applied after checkout;
minimum-spend and product exclusions may apply;
promotions are available for a limited time and while stock lasts; and
delivery charges do not count towards a minimum spend unless stated otherwise.

We may cancel or correct a promotion where there has been an obvious error, misuse or fraudulent activity.

10. Shipping and delivery

Available delivery methods, charges and estimated timeframes are shown at checkout or in our Shipping Policy.

Processing and delivery timeframes are estimates rather than guarantees. Delays may result from carrier disruptions, customs processing, public holidays, severe weather, incorrect addresses or other circumstances outside our reasonable control.

You must provide a complete and accurate delivery address. Contact us as soon as possible if you discover an error. We cannot guarantee that an address can be changed after processing or dispatch.

Risk of loss or damage remains with Nail Void until the order is delivered to you or a person authorised by you, except where you independently arrange a carrier that was not offered by us.

Please contact hello@nailvoid.com promptly if an order is delayed, lost, damaged or delivered incorrectly.

11. International orders

We may deliver to selected countries and regions. Available destinations and products will be shown at checkout.

Customers are responsible for ensuring that ordered products can lawfully be imported into and used in the destination country.

Some products, including certain liquids or adhesives, may be restricted by postal, aviation, customs or dangerous-goods requirements. We may remove these products from an international order or cancel the affected part of an order if they cannot legally or safely be shipped.

International delivery estimates do not include delays caused by customs or local border authorities.

12. Duties, taxes and customs charges

International orders may be subject to import duties, taxes, tariffs and customs-processing fees.

Where these charges are collected at checkout, they will be displayed before you complete your order.

Where they are not collected at checkout, the recipient is responsible for paying them directly to the relevant customs authority, government agency or delivery provider.

Nail Void does not control these charges and cannot guarantee their amount.

13. Refused, unclaimed and returned parcels

If a parcel is refused, unclaimed or returned because:

duties or taxes were not paid;
the address supplied was incorrect or incomplete;
delivery was repeatedly unsuccessful; or
the customer failed to collect the parcel,

Where permitted by law, a refund may be reduced by reasonable and unrecoverable original shipping, return-shipping, customs or handling costs actually incurred by Nail Void.

We will not make these deductions where the return resulted from our error, a faulty product or another matter for which we are legally responsible.

14. Returns, exchanges and consumer guarantees

Returns, exchanges and change-of-mind requests are handled according to our Returns and Exchanges Policy.

Our policies do not exclude, restrict or modify any right or remedy that cannot legally be excluded, including rights under Australian Consumer Law.

Products sold to Australian consumers come with consumer guarantees. If a product fails to meet an applicable guarantee, you may be entitled to a repair, replacement, refund or another remedy. The appropriate remedy depends on the circumstances and whether the failure is major or minor.

We may request photographs, order information and other reasonable evidence to assess a claim.

15. International cancellation rights

Customers in some countries may have mandatory rights to cancel an online purchase within a particular period.

Eligible customers in the United Kingdom or European Union may have the right to cancel certain online purchases within 14 days after delivery without providing a reason.

Where a mandatory cancellation right applies, it operates in addition to our Returns and Exchanges Policy.

To exercise a cancellation right, contact hello@nailvoid.com within the applicable period and include your name, order number and the products being returned.

You are responsible for return postage for a change-of-mind cancellation where permitted by law and where you were informed of that responsibility before purchasing.

Exceptions for personalised, made-to-order, opened or hygiene-sensitive products apply only where permitted by the law governing the transaction.

Cancellation exclusions do not remove your rights concerning faulty, unsafe, damaged or incorrectly described products.

16. Intellectual property

All content on our website—including photographs, product designs, graphics, logos, branding, written content, videos and page layouts—is owned by or licensed to Nail Void and is protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping purposes.

You must not reproduce, modify, publish, distribute, sell or commercially exploit our content without prior written permission.

“Nail Void” and associated branding may not be used in a way that suggests endorsement, partnership or affiliation without our written consent.

17. Reviews and customer content

If you submit a review, photograph, video, comment or other content, you confirm that:

you own the content or have permission to submit it;
it is accurate and not misleading;
it does not infringe another person’s rights;
it is not unlawful, abusive or discriminatory; and
it does not contain harmful code.

You grant Nail Void a non-exclusive, worldwide, royalty-free licence to display, reproduce and share submitted content for review, promotional and marketing purposes.

You may contact us if you would like us to stop using your submitted content in future marketing. This will not affect materials already printed or lawfully published before we process your request.

We may remove content that breaches these Terms.

18. Third-party services and links

Our website may use or link to third-party services, including Shopify, payment providers, delivery carriers, social media platforms and analytics services.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for the content, security or availability of third-party websites or services, except where responsibility cannot legally be excluded.

19. Personal information and privacy

Our handling of personal information is described in our Privacy Policy.

Personal information may be processed by Nail Void and service providers such as Shopify, payment providers, delivery carriers, analytics providers and marketing platforms. Some providers may process or store information outside your country.

Where required, we will request consent before using non-essential cookies or sending electronic marketing.

You may unsubscribe from marketing emails using the link in the email or by contacting hello@nailvoid.com.

20. Errors and website availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may correct typographical errors, inaccurate descriptions, incorrect prices, promotions, delivery charges or availability information.

If an error affects an order already submitted, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

21. Disclaimer and limitation of liability

Nothing in these Terms excludes, restricts or modifies:

any consumer guarantee;
any right or remedy under Australian Consumer Law; or
any other right or liability that cannot legally be excluded.

To the maximum extent permitted by law, Nail Void is not liable for indirect or consequential loss arising from use of the website or products where that loss was not reasonably foreseeable.

Where our liability can lawfully be limited, it will be limited to the remedies available under applicable law.

22. Indemnity

To the extent permitted by law, you agree to compensate Nail Void for reasonable losses, liabilities or expenses directly arising from:

your unlawful use of the website;
your infringement of another person’s rights; or
your material breach of these Terms.

You are not required to compensate us for losses caused by our negligence, unlawful conduct or breach of an applicable consumer guarantee.

23. Suspension and termination

You may stop using our website at any time.

We may suspend or terminate access where we reasonably believe you have materially breached these Terms, engaged in fraud or misused the website.

Rights and obligations arising before termination—including payment obligations, intellectual property rights and applicable liability provisions—will continue where appropriate.

24. Changes to these Terms

We may update these Terms to reflect changes to our products, website, business practices or legal obligations.

The current version will be published on this page with its effective date.

Updates do not remove rights that arose before the revised Terms took effect.

25. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be interpreted or removed only to the extent necessary.

The remaining provisions will continue to apply.

26. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

27. Entire agreement

These Terms, together with the policies referenced in them, constitute the agreement between you and Nail Void regarding your use of the website and purchase of products.

Nothing in this section excludes representations or rights that cannot legally be excluded.

28. Governing law and mandatory rights

These Terms are governed by the laws of New South Wales, Australia.

You and Nail Void submit to the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.

However, nothing in these Terms excludes or restricts any mandatory consumer protection available under the laws of the country in which you ordinarily reside where those protections apply despite this choice of law.

This section does not prevent you from exercising a right to bring a claim in another jurisdiction where that right cannot legally be excluded.
